Waiver of Liability

1. NATURE OF SERVICES & NON-CLINICAL DISCLAIMER

I acknowledge that Human Experiences LLC offers coaching, educational workshops, and somatic practices designed for self-growth, stress reduction, and community connection.

• No Doctor-Patient Relationship: I understand and acknowledge that the Activities are NOT mental health therapy, psychotherapy, medical treatment, or a substitute for professional healthcare. I understand that the facilitators, even if they hold degrees in other contexts, are functioning solely as educators, coaches, and facilitators of life skills and are not acting as my physician, psychiatrist, or clinical therapist. No doctor-patient relationship is established.
• Educational Purpose: I understand that workshops labeled "Embodied Psychological Trauma," "Conflict Transformation," or similar titles are educational programs designed to teach about trauma and resilience skills, or is a facilitated process and does not guarantee that any agreement will be reached, as defined under the exemptions of the Wyoming Mental Health Professions Practice Act (W.S. § 33-38-103(f)). They are not clinical interventions for mental disorders.
• Crisis Protocol: I agree that if I am experiencing a mental health crisis, suicidal ideation, or severe psychological distress, I will immediately cease participation and seek help from a licensed mental health professional or emergency services. I acknowledge that the Released Parties are not equipped to manage psychiatric emergencies.

2. ASSUMPTION OF INHERENT RISKS

I understand that the Activities involve inherent risks, dangers, and hazards, both physical and emotional, which are characteristic of and intrinsic to the Activities and cannot be eliminated without destroying their unique character. I acknowledge that these risks include, but are not limited to:

• Physical Risks of Yoga & Movement: Musculoskeletal injuries (sprains, strains, tears, tendonitis) from Vinyasa flow, Yin poses, or repetitive movements; joint destabilization; nerve compression; dizziness, fainting (syncope), or hyperventilation from Pranayama (breathwork); physical fatigue; and injuries resulting from slips, trips, falls, or contact with the floor/walls.
• Emotional & Psychological Risks: I acknowledge that workshops involving introspection, vision boarding, or trauma awareness may voluntarily elicit intense emotional release, crying, anger, temporary distress, or the resurfacing of difficult or traumatic memories. I voluntarily assume the risk of such emotional experiences as part of the educational process.
• Artistic & Workshop Materials: Risks associated with the use of scissors, cutters, sharp tools, paints, glues, and solvents, including lacerations, allergic reactions, respiratory irritation, or damage to personal clothing/property.
• Sound Healing Risks: Risks of temporary auditory sensitivity, tinnitus, or somatic reactions (nausea, dizziness, headaches) resulting from exposure to high-decibel instruments (gongs, bowls) and vibrational frequencies.
• Premises & Environmental Risks: Risks associated with the venue (e.g., Presenzza®), including equipment failure, uneven flooring, lighting conditions, and risks associated with travel to off-site locations.
• Interactive Risks: Risks arising from interaction with other participants, including interpersonal conflict, vicarious trauma from hearing others' stories, or accidental physical contact.

I hereby assert that my participation is voluntary and that I knowingly and freely ASSUME ALL SUCH RISKS, both known and unknown, including those arising from the ORDINARY NEGLIGENCE of the Released Parties.

3. WAIVER AND RELEASE OF LIABILITY

To the fullest extent permitted by Wyoming law, I hereby forever RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Released Parties from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in the Activities or while on the premises where the Activities are being conducted.

• Scope of Release: This release specifically includes claims based on the ORDINARY NEGLIGENCE of the Released Parties (e.g., instructor error, failure to warn, premises maintenance, negligent supervision).
• Statutory Compliance: I understand that this waiver is intended to function in conjunction with the Wyoming Recreation Safety Act (W.S. § 1-1-121 et seq.), and I accept all inherent risks as defined therein.

4. INDEMNIFICATION

I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all costs, expenses, damages, lawsuits, judgments, and liabilities (including reasonable attorney’s fees and court costs) arising out of or related to: (a) my participation in the Activities; (b) my breach of this Agreement; (c) any injury or damage I cause to other participants or third parties; or (d) any claim brought by my family member, estate, heir, or insurer attempting to circumvent this Release.

5. MEDICAL REPRESENTATION & CONSENT TO TOUCH

• Health Warranty: I represent that I am physically and mentally sufficiently fit to participate in the Activities and have no medical condition (including pregnancy, recent surgery, or cardiovascular issues) that would prevent my safe participation. I agree to assume full responsibility for managing my own limits and will cease participation if I feel pain or severe discomfort.
• Consent to Adjustments: I understand that yoga instruction may involve physical hands-on adjustments. I consent to such touching for instructional purposes. I understand that I have the right to refuse adjustments at any time by verbally informing the instructor or using provided "consent cards."
• Emergency Authorization: In the event of an emergency, I authorize the Released Parties to secure medical treatment on my behalf (e.g., calling 911), but I acknowledge that they have no legal duty to do so. I agree to pay all costs associated with such medical care and transportation.

6. ONLINE/REMOTE PARTICIPATION

If I participate in the Activities online:

• I acknowledge that the Released Parties cannot monitor my physical environment or offer hands-on assistance.
• I agree that I am solely responsible for ensuring my practice area is safe, clear of obstacles, and suitable for the Activities.
• I accept strict responsibility for any injury sustained during remote participation, acknowledging that the Released Parties have no control over my home environment.

7. GOVERNING LAW AND VENUE

I agree that this Agreement and any dispute arising from my participation in the Activities shall be governed by the laws of the State of Wyoming, without regard to its conflict of law principles. I irrevocably consent to the exclusive jurisdiction and venue of the state and federal courts located in Laramie County, Wyoming. I agree that this forum is convenient and waive any objection to this venue.

8. SEVERABILITY

I agree that if any provision of this Agreement is held to be invalid or unenforceable (such as a waiver of gross negligence, if determined by a court), the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law. The invalid provision shall be deemed modified to the least extent necessary to render it enforceable.

9. ACKNOWLEDGMENT OF UNDERSTANDING

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING MY RIGHT TO SUE. I ACKNOWLEDGE THAT I AM SIGNING THE AGREEMENT FREELY AND VOLUNTARILY, AND INTEND BY MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
